Claim procedure
it is the fastest way to resolve disputes. The term for considering a claim, unless otherwise specified in the contract, is 30 (thirty) calendar days. For disputes between legal entities, and in cases expressly provided by law for disputes between legal entities and individuals, it is mandatory to comply with the claim procedure for settling disputes.
According to the annex to the Economic Procedural Code of the Republic of Belarus, the claim must contain:
- surname, first name, patronymic (name) of the applicant of the claim and the person (persons) to whom the claim is presented (recipient of the claim), their place of residence (place of stay) or location;
- the date the claim was made;
- the circumstances on which the claim is made;
- evidence supporting these circumstances;
- claims of the claimant with reference to the legislation;
- the amount of the claim and its calculation, if the claim is subject to monetary value;
- bank details of the claimant (if any);
- list of documents attached to the claim.
