Description of the situation
A Client, who is engaged in international transportation of goods, applied to ProYuristBy. Our Client carried out the transportation of goods, all the necessary documents were signed by the Parties, however, the Customer did not pay within the time period stipulated in the contract for the provision of cargo transportation services.
What have we done?
- We requested from our Client all the documents that he had and which confirmed the fact of the international carriage of goods (a contract for the provision of services for the carriage of goods, a protocol for agreeing on the cost and an act of work performed, international waybills CMR);
- After providing all the documents, we analyzed them and came to the conclusion that our Client has every reason to submit documents to the court in order to recover from the Customer the amount of the principal debt, interest for the use of other people's funds and penalties.
- We have prepared a statement of claim for the Client to recover the amount of debt for the services provided in the transportation of goods, and also calculated the interest for the use of other people's funds and the amount of the penalty. After that, we helped the Client prepare the remaining necessary documents, pay the state duty and filed all the necessary documents with the court.
Result
Because we correctly drew up the statement of claim and the calculation to it, and also correctly collected the missing documents necessary for initiating lawsuit proceedings, the court had only two court hearings to make a decision. Our Client managed to return the amount of the principal debt, recover the amount of interest for the use of other people's funds, part of the penalty amount, as well as the amount of state duty and the cost of legal services.
