The law must always be observed. But, there are times when, thanks to perseverance and the desire to go to the end, you can find a way to get around this law.
What happened?
The Client contacted ProYuristBy law firm with a request to help him obtain a temporary residence permit. The problem was that the Client came to the Republic of Belarus from a country for whose citizens the Republic of Belarus established a visa-free regime, and as you know, you can get a temporary residence permit only if a foreigner has a visa.
What have we done?
We listened to our Client, looked at his documents and analyzed the legal norms that govern the issue. Due to the fact that at the time the Client applied to our law firm, the border between the Republic of Belarus and the Client's country was closed, the Client could not fly to his homeland in order to obtain a visa. Then it was decided to apply to the Citizenship and Migration Department at the place of registration of the Client's temporary stay without the necessary visa.
The Citizenship and Migration Department refused to issue a temporary residence permit to our Client, justifying this by the fact that the embassy of the Republic of Belarus in Ukraine and the Russian Federation can obtain the necessary visa and can be reached there without difficulty. But, firstly, the situation with the spread of COVID-19 was serious, and our Client was not young, and secondly, our Client did not know either Russian or Ukrainian, which would also cause difficulties if our Client decided to visit these countries.
Then it was decided to apply to a higher authority with a request to allow our Client to obtain a temporary residence permit in the Republic of Belarus without a visa - to the Office of Citizenship and Migration. But, unfortunately, they said the same thing as in the Department of Citizenship and Migration: it is impossible to get a temporary residence permit without a visa.
Then we wrote an appeal to the Department of Citizenship and Migration. There they delved into the situation in which our Client found himself, and prepared a letter in which it was indicated that the Client could again apply to the Citizenship and Migration Department in order to obtain a temporary residence permit without a visa.
Result
When applying again to the Department of Citizenship and Migration, the Client was issued a temporary residence permit. The following year, with our help, the Client managed to extend this permit for another year.
