License agreement:
A license agreement is when one party that has the exclusive right to use an intellectual property object (the licensor) grants permission to the other party (the licensee) to use the corresponding intellectual property object.
The license agreement must specify:
- object and type of license (exclusive right);
- rights and obligations of the parties (licensor and licensee);
- the procedure for transferring an object of exclusive right (license);
- the amount of remuneration for the transfer of the object of the exclusive right (license);
- liability of the parties under the license agreement;
- the term of the license agreement, as well as the procedure (including the territory of use).
The following agreements are subject to registration in the state register of license agreements:
- license agreements on granting the right to use objects of industrial property rights protected in the Republic of Belarus (inventions, utility models, industrial designs, plant varieties, topologies of integrated circuits; trademarks and service marks);
- agreements on pledge of property rights, certified by a trademark certificate;
- contracts for the assignment of rights to objects of industrial property rights referred to above;
- amendments and additions to the agreements mentioned above.
